A judge dismissed the case against Fleming after a series of incidents – a key witness recanted her testimony, new evidence was uncovered that implicated someone else and prosecutors reviewing authorities’ files discovered documents that supported Fleming’s alibi.“After 25 years, come hug your mother,” said Patricia Fleming, 71, and that is exactly what he tearfully did, as relatives cheered, “Thank you, God!”When Darryl “Black” Rush was fatally shot in Brooklyn on August 15th, 1989, Fleming was in Orlando and he had tickets, videos and postcards to prove it. But, prosecutors at the time suggested that he could have made a quick round-trip and been in New York at the time of the shooting.
